The controller of your personal data is Optimus Investments, S.L., as coordinating entity and representative of the OPTIMUS Group.

For the purposes of this policy, the OPTIMUS Group comprises companies controlled directly or indirectly by Optimus Investments, S.L., together with other related companies under the Group's control or coordination that may be involved in processing personal data for the relevant purpose.

Depending on the purpose of processing, OPTIMUS Group companies may act as controllers, joint controllers or intra-group processors under Articles 26 and 28 of Regulation (EU) 2016/679 (GDPR).

The OPTIMUS Group currently includes, among others, the following companies (this list is provided for information only and may be updated without amending this policy): Optimus Capital, S.L., Optimus Investments, S.L., Aldea del Fresno 10, S.L., Serenia Alfa, S.L. and Serenia Fidelis, S.L. 

The OPTIMUS Group also operates under several trading brands, including Optimus Global Investors, Optimus Investments and Optimus Homes; these are not separate legal entities.

  1. Purposes for which we process your data

The OPTIMUS Group processes personal data to manage its relationship with users and, where applicable, to administer services provided through OPTIMUS systems.

Personal data provided through the Website or when contacting OPTIMUS by other means may be processed for the following purposes:

  • Contact and enquiry management:
    To maintain contact between the parties, manage Website users, provide customer service and process requests submitted through the available channels.
  • Marketing and promotional communications:
    To send tailored information about activities, products, services, offers and promotions by post, telephone or electronic means (email, newsletters, SMS or other electronic channels).
  • Recruitment:
    To assess professional profiles using CVs and information provided during interviews, group exercises or electronic communications.
  • Statistical analysis:
    To conduct non-intrusive market research aimed at improving the services offered.

The data processed comes from information you provide through the Website or other contact channels and from data generated during your relationship with OPTIMUS.

The following categories of data may be processed:

  • Identification data (first name, surname)

  • Professional data (CV, work experience) 
  • Browsing data (where applicable)
  1. Retention.

We will use your personal data only for as long as necessary to fulfil the purposes described. Personal data will be retained:

  • For the duration of the relationship with the user. 
  • For the periods required to comply with legal obligations. 
  • For marketing communications, until the user requests erasure or objects to processing. 
  • For recruitment, for a maximum of two years after receipt of the CV.

Thereafter, data may be retained in restricted form to comply with legal, tax or accounting obligations and, where applicable, to establish, exercise or defend legal claims.

The lawful bases for processing your data are:

  • Performance of a contract or steps taken before entering into a contract. 
  • Compliance with legal obligations. 
  • The data subject's consent, where required. 
  • Legitimate interests, particularly for marketing similar products or services to existing customers. 

Electronic marketing communications will be sent only where the user has given prior consent or where a pre-existing contractual relationship permits them under applicable law.

Users may object to receiving marketing communications at any time.

You warrant that the information provided is true, accurate, complete and up to date.

If you provide third-party data, you warrant that you have informed those individuals of this policy and have a valid lawful basis for doing so.

Users confirm that they are over 18. Minors may not submit personal data.

Data may be disclosed to:

  • OPTIMUS Group companies where necessary to provide the service. 
  • External providers acting as processors under contract. 

Data will not be disclosed to third parties unless legally required.

Some technology providers may be located outside the European Economic Area. In such cases, international transfers will be made with appropriate safeguards under applicable law, such as standard contractual clauses approved by the European Commission.

OPTIMUS uses Insightly, Inc. as a personal-data processor in compliance with the GDPR.

Appropriate technical and organisational measures have been implemented to protect personal data, although internet security cannot be guaranteed as absolute.

You may exercise your rights of access, rectification, erasure, objection, restriction and portability by emailing legal@optimusinvestors.com or by writing to Optimus Investments S.L., C/ General Oraá 29, 6º derecha, 28006 Madrid, Spain, marked “Data Protection”.

You may also lodge a complaint with the Spanish Data Protection Agency (www.aepd.es).
